§ 1 Information about the collection of personal data and service provider identification
(1) In the following paragraphs we, Hermann Sewerin GmbH, provide information about the collection of personal data when you use the app “SePem® Install Tool” (hereinafter referred to as “SePem app”). Personal data is any data relating to you personally (e.g. name, address, email address(es), user behaviour).

(2) The controller in accordance with Art. 4 Para. 7 EU General Data Protection Regulation (GDPR) and § 13 German Telemedia Act (TMG) (see our legal notice) is:

You can get in touch with our data protection officers at datenschutz@sewerin.com or at our postal address by adding “FAO Data Protection Officer”.

(3) If you contact us by email or using a contact form, we will save your email address and, if provided by you, your company name, your name, your town/city and your telephone number in order to answer your queries (legal bases: Art. 6 Para. 1 (1) lit. a, b, f GDPR). We will delete the data collected in connection with this when it is no longer required to be saved, or – in the case of a legal obligation to preserve records – we will limit its processing.

§ 2 Your rights
(1) You have the following rights with regard to the personal data we hold about you:

(3) You also have the right to lodge a complaint with a data protection regulatory authority about how your personal data is processed in our company.

§ 3 Collection of personal data when you use the SePem app
(1) When you download the SePem app, the necessary information is transmitted to the Google Play Store, in particular your username, email address and client number of your account, time of download, payment information and the individual device code. We have no influence on the collection of this data and are not responsible for it. We process this data only to the extent necessary for you to download the SePem app onto your mobile terminal equipment; (legal bases: Art. 6 Para. 1 (1) lit. b, f GDPR).

(2) When you use the SePem app, we collect the personal data set out below. This is a technical requirement to enable easy use of the functions and to guarantee stability and safety (legal basis: Art. 6 Para. 1 (1) lit. f GDPR).
– IP address
– Time
– Mobile phone number
– Terminal equipment number
– Access to sensors (of smartphone)
– MAC address
– Location data (by GPS and IP address)

§ 4 Special ways of using the SePem app
(1) When you use the SePem app for the first time, we ask you in a pop-up window for permission to use your location data, network (internet), camera, microphone and telephone function (legal basis: Art. 6 Para. 1 (1) lit. a GDPR). If you do not give us your consent, we will not use this data. In this case, you will not be able to use all of the functions of our SePem app. You can also give us your consent at a later stage or withdraw your consent in the settings of the SePem app.

(2) If you allow us to access this data, the SePem app will only access this data and save it locally or transmit it to our server insofar as is necessary to provide the functionality (legal bases: Art. 6 Para. 1 (1) lit. a and f GDPR). We will keep this data confidential and delete it if you revoke the rights of use or if it is no longer required for the provision of services and there are no legal obligations to preserve records.

§ 5 Collecting your location data
(1) Our offer also includes Location Based Services, which we use to provide you with special offers tailored to your respective location. In order to be able to offer you these functions of the SePem app, we collect your location data by GPS and your IP address in anonymised form if you expressly consent to this (legal basis: Art. 6 Para. 1 (1) lit. a GDPR).

(2) You can allow or cancel this function at any time in the settings of the SePem app. In this case your location will only be transmitted to us if you use functions in the SePem app that we can only offer if we know your location.

(3) Your location data will not be used to create movement profiles beyond your current location.

§ 6 Cookies
The SePem app does not use cookies.

§ 7 Data security
We implement the latest technical measures to ensure data security, in particular to protect your personal data against risks during data transmission and from being shared with third parties. These are updated to conform to the state of the art.
